These Terms govern your use of the PDSelect Platform. By accessing or using the Platform, you agree to these Terms. 

  1. Eligibility

The Platform is for registered mental health professionals and post-graduate student health professionals, and verified supervisors. 

  1. Platform Use

You agree to: 

  • Use the Platform lawfully and maintain confidentiality of all client, peer, and supervision information. 
  • Review and verify any AI-generated recommendations before applying them in clinical care. 
  • Adhere to professional codes of conduct and respect community guidelines. 

General disclaimer. All reasonable precautions have been taken by PDSelect to verify the information contained in this platform. However, the material generated is being provided without warranty of any kind, either expressed or implied. The responsibility for the interpretation and use of the material lies with the user. In no event shall PDSelect be liable for damages arising from its use. 

  1. Clinical Guide

The Clinical Copilot provides real-time documentation and evidence-based treatment suggestions to support—but never replace—clinical judgment.
All recommendations must be reviewed and confirmed by a qualified clinician before implementation.

The recommendations, summaries, and decision-support insights generated through PDSelect’s AI-augmented platform are designed to assist qualified mental-health professionals in delivering evidence-informed care. They are based on current best-practice guidelines and available data; however, they do not replace professional judgement, supervision, or client-specific clinical decision-making. 

Practitioners are expected to: 

  • Exercise their own professional expertise, ethical reasoning, and duty of care at all times. 
  • Consider each client’s individual circumstances, preferences, culture, and values, and adapt recommendations accordingly. 
  • Verify and cross-reference AI-generated content against trusted sources before applying in clinical contexts. 
  • Recognise that PDSelect’s outputs are guides; they are not clinical directives or treatment prescriptions. 

Use of PDSelect implies acknowledgement that: 

  • The platform operates as a supporting educational tool, not a provider of clinical services. 
  • Responsibility for all professional decisions and actions remains solely with the registered practitioner. 
  • Neither PDSelect nor its developers accept liability for clinical outcomes or decisions derived from AI-assisted guidance. 

If in doubt, consult your supervisor, senior clinician, or relevant professional board before implementing any recommendation. 

  1. Supervisor Hub

Registered supervisors may list professional details, manage meeting schedules, and document supervision records in compliance with AHPRA supervision standards.
Supervisee data is visible only to the assigned supervisor and system administrators under strict privacy controls. 

  1. Data Backup, Breach Response & Recovery Policy

Purpose:
To ensure the ongoing protection, integrity, and recoverability of all PDSelect platform data, including user, practitioner, and system information. 

Policy Statement:
The PDSelect platform utilises a managed Amazon Web Services (AWS) Relational Database Service (RDS) environment with automatic hourly backups and a retention period of seven (7) to fifteen (15) days. This configuration provides secure, continuous data protection and allows complete restoration of the database to any previous backup point within that timeframe. 

Scope:
This policy applies to all data stored within the PDSelect platform’s database, including (but not limited to) user accounts, professional-development records, CPD logs, and configuration data. No clinical or patient health records are stored within PDSelect unless explicitly stated and separately governed by clinical data-handling policies. 

Key Provisions:
– Automated Backups: Incremental backups occur hourly without manual intervention.
– Retention: Backups are securely retained for up to 15 days in encrypted AWS storage.
– Restoration: In the event of system failure, data corruption, or accidental deletion, the entire database can be restored to any backup snapshot within the retention window.
– Data Integrity: All backups are encrypted in transit and at rest, ensuring compliance with the Australian Privacy Principles (APPs) and ISO 27001 information-security standards.
– Continuity Assurance: Backup and restoration processes are designed to avoid disruption to live operations and maintain platform availability. 

Review & Monitoring:
Backup configurations and recovery tests are reviewed periodically by the PDSelect technical team in collaboration with our hosting partner to verify ongoing compliance and recovery reliability. 

  1. Data Breach Response & Recovery Procedure

Purpose:
To provide a clear, structured process for detecting, assessing, containing, and reporting any potential or actual data breach that could compromise the confidentiality, integrity, or availability of data within the PDSelect platform. 

  1. Definition of a Data Breach:
    A data breach occurs when personal, identifiable, or confidential information is accessed, disclosed, or modified by an unauthorised person, lost, corrupted, or destroyed unintentionally or maliciously, or made unavailable due to system compromise.
  2. Detection & Initial Containment:
    – Automatic Alerts: AWS CloudWatch and monitoring tools alert the PDSelect technical team to unusual activity.
    – Immediate Action: Affected systems are isolated to prevent further access or data loss.
    – Access Suspension: Administrator or third-party access may be suspended during investigation. 
  3. Assessment & Classification:
    The incident response lead determines the type and scope of data affected, sensitivity, risk of harm, and whether it triggers Notifiable Data Breach (NDB) obligations under the Privacy Act 1988 (Cth). All findings are logged in the PDSelect Incident Register.
  4. Notification:
    If the breach meets the NDB threshold, the Office of the Australian Information Commissioner (OAIC) and affected individuals are notified as soon as practicable. Notifications include nature, timing, affected data, and actions taken.
  5. Recovery & Restoration:
    Using AWS RDS hourly backups (7–15 day retention), systems can be restored to the most recent secure backup. Integrity testing and system hardening are performed post-restoration.
  6. Post-Incident Review:
    A root cause analysis is completed, corrective actions are developed, and lessons learned are integrated into policies.
  7. Roles & Responsibilities:
    Technical Lead / Developer Partner (e.g. Dotsquares): Implement containment, forensic review, and restoration.
    PDSelect Data Protection Officer (DPO): Coordinate notifications and compliance.
    Platform Administrator: Communicate with users and oversee audit trails.
    Director / Executive Team: Approve actions and manage service integrity communication. 
  8. Compliance Alignment:
    This procedure aligns with:
    – Privacy Act 1988 (Cth)
    – Australian Privacy Principles (APPs)
    – OAIC Notifiable Data Breach Scheme (2018)
    – ISO/IEC 27001:2022 – Information Security Management
    – NIST SP 800-61 Rev.2 – Computer Security Incident Handling Guide 
  9. Review Schedule:
    This procedure will be reviewed annually or after any significant incident, system upgrade, or change in legislation.
  1. Intellectual Property

Content uploaded or created on the Platform remains the property of its author.
By submitting PD content, you grant PDSelect limited licence to host, display, and promote them within the platform. 

  1. Third-party materials

If you wish to reuse material from this work that is attributed to a third party, such as tables, figures or images, it is your responsibility to determine whether permission is needed for that reuse and to obtain permission from the copyright holder. The risk of claims resulting from infringement of any third party-owned component in the work rests solely with the user. 

  1. Payments & Subscriptions

Paid features (Clinical Guide Pro, PD courses, or supervisor plans) operate on subscription or per-use models.
Refunds apply only as required under Australian Consumer Law. 

  1. Limitation of Liability

PDSelect is provided “as is.” While we strive for accuracy, we make no guarantee that AI suggestions or content will be error-free.
Users accept full responsibility for professional decisions. 

  1. Governing Law

These Terms are governed by the laws of Victoria, Australia, and disputes will be subject to its exclusive jurisdiction. 

All AI-assisted features in PDSelect are designed to support, not replace, clinician judgment. Use of these tools indicates agreement to uphold confidentiality, ethical decision-making, and professional accountability.
